1. Acceptance of Terms
By downloading, installing, accessing, or otherwise using any applications ("Apps") owned by Dailywish.app (“We”, “Us”, “Our”), including but not limited to Motivation App, Good Morning App and Bible App, you agree that you have read, understood, and agreed to be bound by these Terms of Use ("Terms"). Please note, the titles of these Apps may undergo changes periodically for marketing and positioning purposes. Regardless of any such name changes, these Terms will continue to apply. Any references to 'Dailywish.app's Apps' within these Terms refers collectively to all apps owned by Dailywish.app. If you do not agree to these Terms, you must not access or use Dailywish.app's Apps.
2. Eligibility
By agreeing to these Terms, you represent and warrant to us that: (a) you have not previously been suspended or removed from Dailywish.app's Apps; and (b) your registration and your use of Dailywish.app's Apps is in compliance with any and all applicable laws and regulations.
3. Licenses
Subject to these Terms, Dailywish.app's Apps grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download and install a copy of Dailywish.app's Apps on a mobile device and to run such copy of Dailywish.app's Apps solely for your own personal non-commercial purposes.
4. Prohibited Conduct
By using Dailywish.app's Apps, you agree not to: Use Dailywish.app's Apps app for any illegal purpose or in violation of any local, state, national, or international law Violate or encourage others to violate the rights of third parties, including intellectual property rights Post, upload, or distribute any content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate Interfere in any way with the operation of Dailywish.app's Apps or any server, network or system associated with Dailywish.app's Apps, including, without limitation, hacking or defacing, or breaching any security or authentication measures
5. Content and Content Rights
In regard to these terms, the term "Content" embodies items such as quotes, text, images, audio, video, music, software, any kind of authored works, as well as information or other materials that are displayed, provided, or otherwise made accessible via Dailywish.app's Apps. The term "User Content" refers to any Content that users (including you) make available through Dailywish.app's Apps. Ownership of Content is retained by the individual who uploads it. However, when you upload any content through Dailywish.app's Apps, you are providing Dailywish.app's Apps with a non-exclusive, transferrable, royalty-free license, applicable worldwide. This permits Dailywish.app's Apps to utilize, showcase, alter, modify, reproduce, distribute, store, and generate derivative works from your User Content. This is for the purpose of operating and promoting Dailywish.app's Apps across any formats and through any channels. Note that Dailywish.app's Apps doesn't claim ownership over all the Content available in the app, with a significant portion being sourced from other services, partners or received via email from our users. Users are responsible for ensuring they have all necessary rights to the content they provide and for ensuring that their content does not infrive any third-party rights. Dailywish.app's Apps cannot be held liable for any copyright infringements relating to Content provided by users, as Dailywish.app's Apps is merely a platform that allows for the distribution and consumption of such Content.
6. Purchases & Subscriptions
Dailywish.app's Apps offers a service component that operates on a subscription model. The moment you subscribe, you are committing to a recurring, upfront payment structure that follows a billing cycle. If neither party, you or us, decide to terminate the service, it will automatically renew following the same terms at the end of each payment period. If you want to halt the automatic renewal of your subscription, you can do it via your account management page on iTunes or Android. Please be advised that we reserve the right to adjust the pricing of our subscriptions at any time and at our sole discretion. Changes in subscription pricing will generally not affect current subscribers during their existing billing cycle. These changes will take effect at the conclusion of your current billing period. We commit to providing you with reasonable advance notice of any such changes, enabling you to make an informed decision about whether to continue or cancel your subscription before the new pricing takes effect. Please note, if you choose to cancel your subscription and later re-subscribe, it will be at the then-current price. Continuing to use Dailywish.app's Apps after changes to subscription prices have been implemented signifies your acceptance of the revised subscription fee. Please understand that 'Lifetime' refers to the life of the application and not the user's life. Similarly, other purchases, plans or subscriptions are bound by the same principle. We make every effort to provide continuous, uninterrupted services; however, we cannot guarantee the longevity or perpetual availability of the application or any specific features therein. We reserve the right, at our sole discretion, to suspend, discontinue, or delete the application, alter its functionalities, or modify its offerings at any time for any reason. These reasons may include but are not limited to technical issues, business considerations, or new regulatory compliances. In such instances, we may not be able to provide prior notice. Thus, while we strive to provide an excellent user experience, we recommend users to understand these inherent risks before making any purchases or choosing any subscription plans. When it comes to refunds, please note that all the subscription fees and purchases for Dailywish.app's Apps are non-refundable unless mandated by law. By choosing to subscribe to Dailywish.app's Apps, you acknowledge and consent to this policy of non-refundability.
7. Liability Disclaimer
Please note that Dailywish.app's Apps functions solely as a platform to distribute and access various types of Content. We do not endorse, support, or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted or otherwise provided by users through Dailywish.app's Apps. Under no circumstances will Dailywish.app's Apps be liable for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via Dailywish.app's Apps. Moreover, Dailywish.app's Apps shall not be held accountable for any actions taken by users as a result of viewing or interacting with the Content within the app. Users are solely responsible for all decisions and actions taken or made based on the Content or User Content. We strongly urge all users to exercise discretion and to independently verify any information they find on Dailywish.app's Apps before relying on it. To the maximum extent permitted by applicable law, Dailywish.app's Apps disclaims all representations and warranties relating to our Apps and their contents, including regarding any inaccuracies or omissions, warranties of merchantability, quality, fitness for a particular purpose, accuracy, availability, non-infringement or implied warranties stemming from the course of dealing or usage of trade. Dailywish.app's Apps does not guarantee that our Apps will always be accessible, uninterrupted, timely, secure, error-free, or free from computer viruses or other harmful components. We cannot assure that our Apps will not be affected by unforeseeable events such as acts of God, lack of necessary materials, power or telecommunication failures, or failures of IT or telecommunications equipment or facilities. While Dailywish.app's Apps uses reasonable efforts to provide accurate and up-to-date information within our Apps, we make no warranties or representations regarding its accuracy, timeliness, or completeness. Dailywish.app's Apps shall not be liable for any acts or omissions by third parties, or for any direct, indirect, incidental, special, consequential or punitive damages resulting from or in connection with the use of our Apps, your access to, inability to use, or reliance upon our Apps or services, including, but not limited to damages for loss of business or profits, use, data or other intangibles, even if we have been advised of the possibility of such damages. Regardless of the cause, Dailywish.app's Apps shall not be liable in contract, tort (including negligence or breach of statutory duty), or otherwise, for any indirect, consequential, collateral, special, or incidental loss or damage suffered by you in connection with our Apps and these Terms of Use. Indirect or consequential loss or damage includes, without limitation, loss of revenue, profits, anticipated savings or business, loss of data or goodwill, loss of use or value of any equipment including software, third-party claims, and all associated and incidental costs and expenses. The above exclusions and limitations apply only as far as the law permits. None of your statutory rights as a consumer that cannot be excluded or limited are affected. Despite our efforts to ensure system security, you acknowledge that all electronic data transfers carry potential risks. Dailywish.app's Apps cannot guarantee that data transfers related to our Apps, or electronic mail sent to and from us, will not be monitored or read by others.

Dailywish.app's Apps reserves the right to change these Terms at any time. We will make commercially reasonable efforts to notify you of any material updates to these Terms; however, you should also check these Terms periodically for changes. Your continued use of the Dailywish.app's Apps app after new and/or revised Terms are effective indicate that you have read, understood, and agreed to those Terms.

10. Termination

Upon any termination, discontinuation, or cancellation of Dailywish.app's Apps, all provisions of these Terms which by their nature should survive will survive, including, without limitation, ownership provisions, warranty disclaimers, limitations of liability, and dispute resolution provisions.
11. Governing Law and Dispute Resolution
These Terms will be governed by and construed in accordance with the laws of the Republic of North Macedonia, without regard to its conflict of law principles. Any disputes that cannot be resolved between us will be settled under the rules of arbitration specified under the law of the Republic of North Macedonia.
